Justice William Garnett of the New York State Supreme Court ruled that the details of the grand jury investigation into the death of Eric Garner will not be released to the public.

The New York Civil Liberties Union, Letitia James (New York city’s public advocate), the National Association for the Advancement of Colored People, and The New York Post had previously requested the release of the grand jury details.

Judge Garnett said he denied the request because the requesting parties failed to establish a "compelling and particularized need".

A team of "senior level FBI agents with decades of experience in long-term criminal and public corruption cases" have been assigned to conduct the federal investigation into the death of Eric Garner. As part of the investigation, here's a list of things the team will be doing:

  • visit the scene where the incident took place
  • interview witnesses and review witness testimony
  • look over evidence from the NYPD's internal affairs investigation
  • might ask to interview officers and emergency medical technicians who responded on the day of the incident
  • determine if a chokehold was in fact used

In early August, 2014, the New York City Medical Examiner ruled Garner's death a homicide, that he died from "compression of chest and prone positioning during physical restraint by police", and stated that acute and chronic bronchial asthma, obesity and hypertensive cardiovascular disease were contributing factors in Garner's death.

Pantaelo is the police officer who allegedly put Eric Garner in a chokehold for selling untaxed cigarettes on July 18, 2014. In a video of the incident, Eric can be heard saying "I can't breathe" as four officers wrestle him to the ground and Pantaleo applies a chokehold.

New York City Mayor Bill de Blasio spoke at a news conference about the grand jury decision and the death of Eric Garner.

Mayor De Blasio also released a formal statement in which he talks about what is being done in New York City to avoid future incidents like the death of Eric Garner, specifically:

  • a reduction in the overuse and abuse of stop-and-frisk

  • a change in the marijuana policy to reduce low-level arrests
