New York Judge Issues Partial Summary Judgment in Letitia James Civil Fraud Lawsuit Against Donald Trump

Judge Arthur Engoron issued a partial summary judgment in the lawsuit filed by Attorney General Letitia James against Donald Trump.

In the judgment Engoron declared that Trump and his family business fraudulently inflated the value of Trump's properties and other assets, and that the inflated values were then used by himself, Donald Trump Jr., Eric Trump, and his business to obtain better loan and insurance terms.

The properties include Trump's Mar-A-Lago estate in Florida, his own triplex apartment in New York City, 40 Wall Street (the Trump Building), Trump Park Avenue, multiple golf courses, and an estate in upstate New York.

Engoron also ordered the cancellation of business certificates in New York that let some of Trump's businesses, including the Trump Organization, operate in New York, and ordered the appointment of independent receivers to manage the dissolution of the businesses.

On social media Donald Trump responded:

This is Democrat Political Lawfare, and a Witch Hunt at a level never seen before. If they can do this to me, they can do this to YOU!

On social media Eric Trump responded:

Today, I lost all faith in the New York legal system. Never before have I seen such hatred toward one person by a judge.

Engoron also sanctioned Donald Trump's lawyers for presenting "bogus arguments," ordering five attorneys (Christopher Kise, Michael Madaio, Clifford S. Robert, Michael Farina, and Armen Morian) to pay $7,500 each within 30 days.

The trial portion of the lawsuit is scheduled to begin on October 2.

New York State Attorney General Letitia James filed a $250 million civil fraud lawsuit against Donald Trump, three of his children (Donald Trump Jr., Ivanka Trump, and Eric Trump) and the Trump Organization.

The 222-page lawsuit seeks to revoke the Trump Organization's business certificate (barring it from doing business in the state of New York), to permanently bar Donald Trump and the three children from serving as officer or director of any business entity in New York (including their family's company), and a five-year ban on Donald Trump and the Trump Organization from acquiring real estate in the state of New York or applying for loans from any New York-based company.

According to the official New York State Attorney General press release:

The lawsuit alleges that Donald Trump, with the help of his children Donald Trump, Jr., Ivanka Trump, and Eric Trump, and senior executives at the Trump Organization, falsely inflated his net worth by billions of dollars to induce banks to lend money to the Trump Organization on more favorable terms than would otherwise have been available to the company, to satisfy continuing loan covenants, to induce insurers to provide insurance coverage for higher limits and at lower premiums, and to gain tax benefits, among other things. From 2011-2021, Mr. Trump and the Trump Organization knowingly and intentionally created more than 200 false and misleading valuations of assets on his annual Statements of Financial Condition to defraud financial institutions.

This conduct was in violation of New York Executive Law 63(12), which gives the Office of the Attorney General (OAG) special and broad powers to go after persistent and repeated fraud and illegality, which in this case includes violating other state laws prohibiting the submission of false financial statements, the falsification of business records, and the commission of insurance fraud

At a news conference James said:

Claiming that you have money that you do not have does not amount to the art of the deal, it's the art of the steal.
